HC Asks DGP TO Shift SHO Bandipora

SRINAGAR  The Jammu and Kashmir high court has sought an affidavit by SHO Bandipora for not complying with the directions of the Court in connection alleged abduction of wife of a man, observing that the police officer has prima facie committed contempt of the court

The order passed by this Court on 16.04.2019, directing the SHO Police Station, Bandipora to produce the Respondents 6 and 7 before the court on the next date of hearing i.e. today, the 14th of May, 2019, has not been complied with, a bench of Justice Ali Mohammad Magrey said.

Report of Registry revealed that copy of the order was provided to the counsel for the state and notice for appearance of SHO Police Station Bandipora, was served on the Senior Superintendent of Police, Bandipora on 22 April 2019.

The Superintendent of Police, Bandipora, has adopted a casual approach in implementing the orders passed by this Court, therefore, he shall submit his explanation on affidavit as to what steps he has taken for implementation of the order.

Since SHO Police Station Bandipora has not complied with the directions of the Court, therefore, prima facie he has committed contempt, as such, notice shall be issued to him to show cause as to why he shall not be punished for contempt of Court, the bench said.

Senior Superintendent of Police, Bandipora, shall ensure appearance of SHO Police Station, Bandipora as also Respondents 6 and 7 before the Court on the next date of hearing, the court said. It also directed Director General of Police, J&K,to ensure shifting of SHO Police Station Bandipora and report compliance on the next date of hearing.
