SRINAGAR (KNS) – Weeks after rumors of an MLC having being caught red handed in an immoral act, a city court on Wednesday acquitted him of all charges, saying police failed to produce substantial evidence.
Court of Chief Judicial Magistrate (CJM) Srinagar dismissed the case against Altaf Ahmad Kaloo former MLC from Pahalgam against whom police had registered a case under section 294 and 188 RPC. Court held that no prima facie case is made out against the Kaloo.
KNS quoting sources reported, that prosecution in the case argued to convince the court that the case should go for trial but no able argument was sufficient to displace legal and factual requirements for proceedings with the trial.
Im of the considered view that merely hugging at public place with out there being further explanation of circumstances which could be of such nature which could deprive or corrupt minds of those whose minds are open to such immoral influences i.e common public, would not be construed as an incident or obscene act, court observed.
From the circumstances as are reported in the charge sheet, I dont find any prima facie evidence available on record which would entail proceedings with the trial of the case. Therefore, the circumstances are sufficient to apply the provisions of section 249 Cr.pc and to stop the proceedings. Accordingly in terms of section 249 Cr.pc the proceedings in the chargesheet is stopped and the accused released, it added.
Pertinently, a former Member Legislative Council (MLC) of the ruling National Conference (NC), Altaf Ahmad Wani alias Altaf Kaloo was arrested on 10th September this year by police at Nigeen under allegations of obscene act at public place.
