Srinagar: Court of Judicial Magistrate (Munsif Court) Magam has directed SHO and DySP Magam to ensure their appearance in person before it on next date of hearing for questioning the integrity of court of law.
Court of Judicial Magistrate, Lubna Shaheen took serious cognizance of the report submitted by police involving a gang of car lifters in which the integrity of court was overtly questioned.
Pertinent to mention here that Budgam police on March 2nd busted a gang of car lifters by arresting three people and recovering fake documents and eleven stolen vehicles on their instance.
Police according to CNS accordingly registered a case FIR No 19/2017 under section 379, 420, 467, 468, 471, 411, 120-B RPC in Police Station Magam and a team under the supervision of SDPO Magam was constituted.
SHO police station Magam, who has been appointed as Investigating Officer (I.O) in the case in his report, submitted before the court of Judicial Magistrate through prosecuting Officer (P.O) had mentioned that the fingers of doubt will be raised on the credibility of the court in case any of the accused will be granted bail.
This is humble appeal to the honble court not to grant bail to the accused as the same will put an adverse impact on the society and questions will be raised over the authenticity of the court, reads the last clause of the report submitted by police in the court today.
Defense Counsel, Amir Peerzada and Shaukat Dar representing accused one of the accused in the case vehemently opposed the police remark saying police is not above law hence cannot dictate terms to the court which is the supreme authority.
Does police wants to convey that the Honble court is corrupt, this tantamount disgrace to the court, hence court should take serious cognizance of the issue and held erring official answerable under contempt of court charges, defense counsel said while arguing the matter.
The court after hearing arguments of the defense counsel, directed the SHO and SDPO Magam to appear in person before the court to explain their position on next date of hearing scheduled on March 11. (CNS)
