SC Stays Contempt Proceedings Against Accused Police Officials

New Delhi: The Supreme Court on Tuesday put on hold contempt proceedings against Inspector General of Police Kashmir Zone and SSP Srinagar for not registering an FIR against the accused Deputy Superintendent of Police for allegedly killing a youth Shabir Ahmed Mir during the ongoing protests in Tengpora Batamaloo area of Srinagar city on July 10 last month.
Court of Chief Judicial Magistrate Srinagar Masrat Shaheen on Monday had issued a fresh non-bailable warrant against SSP Srinagar for not being present in the court and directed Inspector General of Police (Kashmir) to file an FIR against a DySP in connection with the killing.
Seeking a report on the investigation into the incident, including the complaint against the Deputy Superintendent of Police, the bench of Justice Pinaki Chandra Ghose and Justice Amitava Roy said that the state Inspector General of Police and Senior Superintendent of Police would neither be arrested nor placed under suspension.
Appearing for the J&K government, Attorney General Mukul Rohatgi told the court that the matter, including the complaint involving the killing of Shabir Ahmed, would be investigated.
The Attorney General said that registration of fresh FIR against the DSP as ordered by the Srinagar Judicial Magistrate would have a ‘demoralizing effect’ on the police force and their operations to control violent and unruly demonstrations.
Earlier, the CJM court on July 18 and July 29 had directed the SSP to file an FIR against DySP Yasir Qadri and other personnel over the killing of one Shabir Ahmad Mir allegedly inside his house on July 10 last month. (CNS)
