SrinagarThe J&K High Court on Monday issued non-bailable arrest warrant against Consumer and Public Distribution Departments Assistant Director Kupwara for non-compliance of its orders and asked SSP Kupwara to get him before it on Wednesday.
A bench of Justice Ali Mohammad Magrey directed its registry to issue the non-bailable warrant of arrest against the Assistant Director Mushtaq Ahmad to be executed by SSP Kupwara.
It asked the police officer to get him arrested and produce before the Court on November 29 at 2 PM.
The court also directed the registry to issue Rule and frame Robkar against the Assistant Director Mushtaq Ahmad. The matter pertains to issue regarding Kerosene Oil license granted in favour of one Javid Ahmad War son of Ghulam Ahmad War of Bohipora Kupwara.
On 1 September 2014, the court had ordered that Kerosene Oil license shall remain in force for one month only.
Consequently, one month after the passing of the order, the license became non-operational, the court said.
Subsequent by another order on 11.12.2014, status quo was ordered to be maintained, meaning thereby that the license in question would continue to be non-operational, the court said.
It is alleged that despite the Court directions, Assistant Director, CA&PD Department, Kupwara has been allocating kerosene oil to (War), the court said, Despite notice (the Assistant Director) has chosen not to submit the compliance of Court orders.
On 30 August this year, last and final opportunity of two weeks was granted to the assistant director to file statement of facts, failing which he was directed to appear in person. On 13.11.2017, despite direction neither statement of facts was filed, nor the Assistant Director. Consumer and Public Distribution Department, Kupwara appeared, therefore. Court had no option but to seek appearance of Assistant Director, Consumer and Public Distribution Department, Kupwara by adhering to coercive method.
However, on the undertaking of Asif Ahmad Bhat to ensure presence of Assistant Director, Consumer and Public Distribution Department, Kupwara, the process was deferred.
Today neither statement of facts filed nor Assistant Director, Consumer and Public Distribution Department, Kupwara, is present in person.
Asif Ahmad Bhat, AAG, when asked submitted that he has communicated the directions of the Court not only in writing but telephonically also to the Assistant Director, Consumer and Public Distribution Department, Kupwara, to appear in the Court but the officer despite knowledge has overlooked the Court directions.
