SRINAGAR: The Division Bench comprising Justice Hasnain Masoodi and Justice Dheeraj Singh Thakur has suspended two Assistant Professors who had been employed at Sher-i-Kashmir Insititute of Medical Sciences in 2010.
Citing their inexperience and lack of required qualification as the reason of their suspension, the Division Bench said these two doctors cant be appointed as Assistant Professors in Physical Medicine and Rehabilitation (PMR) Branch of the Institute as they lack experience and qualification.
The Division Bench awarded the judgment in response to a Public Interest Litigation (PIL) filed by one Muhammad Sayed Shah in which he pleaded through his counsel Advocate Imatiyaz Ahemd Sofi that SKIMS authorities vide order number 34SKIMS of 2010 appointed two persons namely Dr Javid Ahmed and Dr Abdul Hamid Rather as Assistant Professors.
Advocate Sofi prayed that both the doctors lacked experience and requisite qualification and were thus been appointed by violating all the norms of the Institute. The duo cant do justice towards their post and they lack the qualification that has been set by Medical Council of India, Sofi informed court and appealed that the appointment orders of the duo should be declared null and void.
The court observed that Dr Abdul Hameed Rather and Dr Javaid Ahmad in the present case beyond any doubt, were ineligible to hold the post of assistant professor in the PMR and thus both were suspended accordingly.
