Dooru resident detained 11 times under PSA
SRINAGAR: Releasing its fact finding report about district jails of Udhampur, Kuthua and sub-jail Heera Nagar, Kashmir Bar Association has stated that a resident of Batgund, Dooru, Peer Mohammad Ashraf son of Peer Ghulam Nabi languishing in District Jail Kuthua has been detained 11 times under Public Safety Act (PSA sofar.
The said youth told visiting Bar team that he was facing trial before the Additional District and Sessions Judge, Anantnag but due to non availability of the docket and escort he has not been produced before the said court, the report reads.
The report said that out of 112 inmates there were 98 under trials including a female in District Jail Kathua. The Kashmir youth lodged in the said jail have been identified as Peer Muhammad Ashraf, Tariq Ahmad Shah son of Ghulam Nabi Shah resident of Bijbehara, Sabzar Ahmad Bhat son of Ghulam Ahmad Bhat resident of Kulgam, Muhammad Najeeb Bhat son of Mohammad Yousuf Bhat resident of Kulgam, Rafiq Ahmad Dada son of Ghulam Mohi-ud-Din Dada resident Tral Bala, Nazir Ahmad Rather son of Ali Muhammad Rather resident of Dadsara Tral, Majid Maqbool Bhat son of Muhammad Maqbool Bhat resident of RadvaniBala, Kulgam, Kifayat-Ullah Zargar son of Muhammad Sharief Zargar resident of Kishtighar, Dooru, and Muhammad YousufMagray son of Abdul Gani Magray resident of Lasipora.
One of the inmate is from Faisalabad Pakistan and he has been identified as Ajaz Ahmad Bhat son of Riyaz Ahmad Bhat. The Pakistani resident stated that after 8 years all cases against him have been cleared and now he is waiting for deportation order, the report said.
The Bar in its report has stated that PSA of two inmates,Tariq Ahmad Shah and Sabzar Ahmad Bhat have been quashed, but they have not yet received the quashment order yet.
The report further said that three Muslim youth from Burma have also been lodged in District Jail Kathua who stated that they were implicated in false cases.
Extending gratitude to Jail authorities for their cooperation, the Bar Team in its report said that all the inmates complained of lack of medical facilities in the jail.
According to CNS, the Kashmir Bar Association in its report has stated that there are 2 Kashmiris and 8 foreigners languishing in Sub-Jail Heera Nagar. The two Kashmiri inmates have been identified as Zahoor Ahmad Bhat son of Ghulam Qadir Bhat resident of Trehgam Kupwara and Imtiyaz Ahmad Bhat son of Ghulam Rasool Bhat resident of Sheeripora, Anantnag.
The Bar in its report has claimed that among 8 foreigners, 5 have completely turned mentally retarded due to the continuous detention in various jails and interrogation centers.
According to Bar report, in District Jail Udhampur 15 persons are facing trial under Section 302, 7/25, 307 and other offences before the Court of Principal District and Sessions Judge, Udhampur and District and Sessions Judge, Ramban as under trials and 4 persons namely Sajad Ahmad Nawoo son of Muhammad Sultan Nawoo resident of Sumbal, Pervaiz Ahmad Wagay son of Abdul Rashid Wagay resident of Shiganpora, Kulgam, Amir Hamzah Shah son of Ghulam Mohi-ud-Din Shah resident of Koilmuqam, Bandipora and Showkat Ahmad Mir son of Abdul Rehman Mir resident of Baniyari, Sumbalare have been lodged in the jail under PSA.
Besides these persons,Abdul Qayoom Minhas son of Abdul Rehman resident, Muhammad Rafiq Chunail son of Muhammad Sultan resident of Gool, Tariq Ahmad Thanchoo son of Abdul Gani all residents of Gool, Abdul Majeed Beigh son of Shahab-ud-Din Beigh resident of Rajouri, Manzoor Ahmad Khan son of Muhammad Afzal Khan resident Banihal, Mohammad Mushtaq son of Mohammad Akbar Lone resident of Sangaldan, Gool, Manzoor Ahmad son of Mohammad Nayeeb resident of Gool Dilwa, Shakeel Ahmad, Farooq Ahmad and Khurshid Ahmad are lodged in the said jail as under trials. The said under trials stated that are not being provided proper legal advice and they apprehend that they are not being provided fair trial, the report states.
Kashmir Bar Association has said that besides providing congenial atmosphere, steps should be taken for proper legal aid to the inmates facing trial before different courts in Jammu province.
