Srinagar – The State Human Rights Commission Wednesday dismissed the complaint filed by the relatives of deceased persons in the Bhaderwah triple murder case against former director-general of police, Kuldeep Khoda.
Rejecting the contention of the complainants, the SHRC division bench comprising Javed Kawoos and Rafiq Fida in its order said, We are of the opinion that it will be a sheer exercise in futility to take the matter on board which stands otherwise already finally disposed off by the Honble High Court, trial court of principal sessions judge, Bhaderwah, National Human Rights Commission as also by this Commission, while disposing off earlier petition No. 235 of 2011.
Citing the High Court judgment, the SHRC said it could not override the findings of the High Court
The Jammu and Kashmir police had earlier submitted the Crime Branch enquiry report about the Bhaderwah triple murder case in the SHRC with the request that the document be treated as privileged. The case was agitated by the son of one of the deceased, Fazal Husain Dar, and brother of Fareed Husain Dar.
Pertinently, the former DGP, Kuldeep Khoda, had been implicated in the case by a Crime Branch progress report that had come to light through the media on August 13, 2011.
In the petition filed before SHRC, a plea had been made to order an investigation into the 1996 incident by its own (SHRCs) investigating agency and after ascertaining the facts of the case recommend prosecution against the real culprits.
According to the petition, the investigation conducted by superintendent of police, Crime, Bachan Singh Choudhary, had blamed one Muhammad Ashraf for executing three civilians Fazal Muhammad Dar, his son Fareed Ahmad Dar and their neighbor, Muhammad Husain Dar, in 1996.
Meanwhile, the coordinator of Coalition of Civil Societies, Khurram Parvez, has expressed dissatisfaction over the SHRC pronouncement. The SHRC has based its judgment in the triple murder case on the Crime Branch report, which was prepared by the accused Kuldeep Khoda himself when he was the inspector-general of police, Crime Branch. How can a report prepared by the accused be taken as authentic, he asked. (KNS)
