SRINAGAR The Jammu and Kashmir High Court on Friday ordered Chief Executive Officer Mansbal Development Authority to file a detailed report about the steps taken for preservation and protection of the Mansbal lake in central Kashmirs Ganderbal district.
Hearing a suo-moto Public Interest Litigation, a division bench of Justices Ali Mohammad Magrey and Tashi Rbastan also asked the CEO to file details with reference to the mechanism in vogue for disposal of the solid and liquid waste in and around the lake and ensure that no constructions are permitted in the area against the Master Plan and the byelaws in vogue.
The direction by the court followed its observations that authorities at the helm of affairs are not taking any effective steps for preservation and protection of the precious water body.
The directions and observations by the court followed submissions by advocate Nadeem Qadiri, amicus curie whol while making submission with reference to the development at Sonamarg placed on record photographs and a document prepared by him having reference to the initiatives to save the water body.
From the perusal of the document/photographs it appears that the authorities at the helm of affairs are not taking any effective steps for preservation and protection of the lake. We deem it proper to include the subject with the present PIL (regarding Sonamarg) by taking on record the document and implead Chief Executive Officer Mansbal Development Authority as party respondent in the PIL, the court said and issued notice to him which was waived by additional advocate general M.A. Chashoo.
He shall file response before next date of hearing. The Chief Executive Officer Mansbal Development Authority shall file a detailed report about the steps taken for preservation and protection of the lake. He shall also file details with reference to the mechanism in vogue for disposal of the solid and liquid waste of the lake and around.
The Chief Executive Officer, the court said shall ensure that no constructions are permitted in the area against the Master Plan and the byelaws in vogue.
He shall also report about the construction in the area by or before next date of hearing.
Meanwhile, Nadeem Qadri also brought to the notice of the court that heap of garbage is lying outside the G.B.Pant Children Hospital Srinagar. He submitted that non-compliance of the Waste Management Disposal Rules has resulted in deposition of the huge garbage outside the hospital which is not only hazardous but dangerous for the life of the children who are approaching the hospital for treatment.
We direct Chief Executive Officer Cantonment Board who is stated to be managing the control of the area with reference to ensuring proper hygiene and other sanitary facility, to ensure lifting of the garbage/waste which is stated to be dumped in and around the G.B.Pant Children Hospital without any further delay.
He shall also ensure disposal of the waste in terms of the Solid Waste Management Rules 2016 and file compliance, the court said. Advocate S.A.Makroo who is appearing on behalf of Chief Executive Officer Cantonment Board shall file response and compliance of the direction by or before next date of hearing, the court said, adding, Medical Superintendent, G.B.Pant Children Hospital shall also file his report about the steps taken for ensuring proper hygiene in and around the Hospital. The case has been listed on May 24.
