SRINAGAR The Jammu and Kashmir High Court has asked Principal District Judge Srinagar, shall ensure expeditious decision of the matters having reference to widening of the road from Dalgate to Hazratbal.
Hearing a Public Interest Litigation, a division bench of Justices Ali Mohammad Magrey and Tashi Rabstan also sought list of the petitions pending before it and asked its Registrar Judicial to list all those cases before the roster Bench on May 21.
The orders were passed by the court after perusing of Chief Engineer, PWD (R&B) Kashmirs affidavit, indicating the steps taken for ensuring disposal of the cases, pending before the various Courts with reference to subject of the completion of ongoing road widening from Dalgate to Hazratbal.
M. A. Chashoo, AAG, when asked about the latest position of the cases, submitted that these cases are still pending decision before the Principal District, Srinagar, Sub Judge/Small Causes Court, Srinagar and the high Court.
The court asked the AAG to furnish the list of the writ petitions to the Registrar Judicial of the high Court during the course of week. On receipt Registrar Judicial shall list all those cases before the roster Bench on May 21.
The AAG, the court said, shall also ensure completion of the pleadingsfiling of reply before the Registry.
Principal District Judge Srinagar, shall ensure expeditious decision of the matters having reference to widening of the road from Dalgate to Hazratbal pending before its Court and other Courts of the district, the court said and asked Chief Engineer R&B to furnish details to him during the course of week.
In the status report, it was submitted that non-availability of the sufficient funds, the project is yet to be completed and the matter has taken up with the Administrative Department for release of funds.
Let the Principal Secretary to Government Public Works Department, Kashmir shall file response with reference to release of funds for completion of the project, the court said and ordered listing of the PIL on May 21.
On previous date of hearing, the court directed Chief Engineer, PWD (R&B) Kashmir to set-out the dates with time lines with regard to all the matters including approval of the proposal of road widening from Dalgate to Hazratbal Srinagar.
Hearing a petition, complaining unwarranted delay in making the road widening from Dalgate to Hazratbal, court had had directed the Chief Engineer to file an affidavit, setting out the dates with time lines with regard to all the matters including approval of the proposal of road widening; the necessary steps for the purpose and the current status including the date wise steps taken in the acquisition process.
