SRINAGAR Observing that department is the custodian of service book, and other service records of the employee, the State Human Rights Commission has come to rescue of a poor forest guard, ordering release of leave salary, gratuity and the provident fund to the family of the guard who passed away in 1990.
It is an unfortunate case and a reflection on the system we are working in. A poor Forest Guard has died in 1990. Almost thirty years have passed his family has not received pension. His leave salary, gratuity has `not been paid to his family. His family has not been extended other benefits which otherwise his family was entitled to, the SHRC said chairman Justice (retd) Bilal Nazki in an order passed last week.
Even if we try to correct wrongs that have been committed by the department, then we cannot compensate the family for the agony they must have undergone in last three decades. This all has been done on the ground that service book and appointment order of the deceased is not available with the Department. This is the fault of the department. Department is the custodian of service book, and other service records of the employee.
Due to fault of the department, the SHRC said, the family of the deceased forest guard is suffering.
The department has the record of ten years regarding payment of salary to the deceased. In my view, this should have been sufficient to settle the dues of the deceased but it has not been done.
After the Commission took notice, the chairperson said, it appears that only a letter was sent by Conservator Srinagar to the Accountant General, seeking instructions in the matte.
Personally I feel that even the family Pension could have been referred to AG on the basis of ten years record salary of the deceased but it appears that the department does not want to help the poor family.
The department, the Commission said, shall immediately pay leave salary, gratuity and the provident fund to the deceaseds family.
Fox fixation, of pension, Accountant General and AG be informed that service book is not available, the Commission said and ordered that copy of the order b sent to the Chief Secretary so that he is also aware of the injustice that has been done family for last thirty year. the case has been listed on May 28.
