SRINAGAR A day after admitting that teacher from Awantipora died in its custody at Srinagar, police on Wednesday filed FIR under 224 RPC which pertains to escape or attempts to escape from custody.
Amid new twist, the magisterial inquiry at Srinagar has been also closed and a fresh magisterial inquiry has been initiated in Pulwama district of South Kashmir and a report sought in four weeks.
A case under FIR number 09/2019 under section 224 RPC, a police officer told a local news agency GNS.
Section 224 RPC reads: Whoever intentionally offers any resistance or illegal obstruction to the lawful apprehension of himself for any offence with which he is charged or of which he has been convicted, or escapes or attempts to escape from custody in which he is lawfully detained for any such offence, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.
The punishment under 224 RPC section is in addition to the punishment for which the person to be apprehended or detained in custody was liable for the offence with which he was charged, or of which he was convicted.
On Tuesday, a police spokesman said: In pursuance of terror case investigation, one suspect Rizwan Pandit resident of Awantipora was in police custody. The person died in police custody. In this matter while following the procedure laid down in section 176 of CrPC a magisterial enquiry is underway. Separately, police investigation has also been initiated in the jurisdictional area of incident.
Rizwan was principal of Sabir Abdullah Jobwarara Awantipora School, a private school and according to his family, he was detained two days back.
Talking to GNS, Deputy Commissioner Srinagar Shahid Iqbal Choudhary said that after the police informed that the incident occurred in Krew area of Pulwama following which case has been shifted in Pulwama.
Now Assistant Commissioner Revenue (ACR) Pulwama Qazi Masood has been appointed as an inquiry officer and a report has been sought in four weeks. (with inputs from GNS)
