SRINAGAR The Jammu and Kashmir High Court on Tuesday expressed satisfaction over the requisite steps taken by the government for implementation of the recommendations by one-man Commission of Inquiry (CoI) headed by Justice (retd) M L Koul into the 2010 killings.
The court was also the Public Interest Litigation concerning the civilian killings allegedly at the hands of police and government force in 2010 and seeking investigation of the cases and to make public the report submitted by the Commission public.
We have examined the recommendations and the Action Taken Report submitted before this court and are satisfied that the respondents have taken the requisite steps for implementation of the recommendations in tune with the directions passed by this Court in OWP no. 19/2011. We are conscious of the concern shown by this court in the said petition, PIL, while registering the constitution of the Commission of Enquiry by the Government said a bench of Justices Ali Mohammad Magrey and Sanjeev Kumar.
The directions were passed by the court after perusal of the CoI report submitted before the court in a sealed cover in view of the sensitivity and security concern expressed by the state.
Besides making the report public, the PIL had sought the directions to the government to implement the recommendations of the CoI including those regarding grant of compensation to the victim families.
It also sought directions to the government to submit the action taken report with respect to findings of the Commission before the Court.
The state Government, in the reply, had stated that the requisite steps for implementation of the recommendations with reference to payment of Ex-gratia amount etcetera have been taken.
Taking overall facts and circumstances and the relief prayed for in the PIL into consideration, we feel satisfied that the issue involved in the instant PIL is taken care of by the order passed by this Court in PIL no. 19/2011, therefore, shall stand governed by the same, the court said, adding, However, if any individual is dissatisfied with the investigation or the quantum of relief released by the Government shall be at liberty to approach the competent forum for seeking the appropriate relief.
