SRINAGAR The J&K High Court has said that pendency of a case with General Administration Department is not a ground for delaying the process of implementation of the Court direction, state high court said.
A bench of Justice Ali Mohammad Magrey made observation while hearing a petition Shakir Skinder Bhat and the court had in November 2015 asked the government to consider the case of the petitioner for promotion against the post of Assistant Engineer (Civil) in accordance with rules and regulations.
Compliance of final order dated 28.11.2015, passed in SWP No. 2632/2015 directing the respondent no.1 to consider the case of the petitioner for promotion against the post of Assistant Engineer (Civil) in accordance with rules and regulations, Policy circular and the decision of the Supreme Court as referred to in the aforesaid order dated 28.11.2015 has remained un implemented till date, the court said.
Additional advocate general , Irfan Andleeb, appearing on behalf of the respondent, submitted that the case is submitted to General Administration Department for seeking guidance with reference to pendency of some case against the petitioner.
Pendency of a case with General Administration Department is not a ground for delaying the process of implementation of the Court direction, such direction is required to be implemented by considering and passing the appropriate orders, the court said and granted government three weeks time to file compliance.
