J&K HC To Have First Woman Judge
SRINAGAR The Government of India has cleared two names for appointment as Judges of the J&K High Court and one among them is Sindhu Sharma, the sister-in-law of Union Minister Arun Jaitley. She would be the first woman judge of the J&K high court.
The other is the former District and Sessions Judge, Rashid Ali Dar, sources said. Sharma is presently Assistant Solicitor General of India in J&K High Court Jammu Wing while Dar retired as Principal District and Sessions Judge Srinagar on November 20 last year.
The file is presently in the office of President, Ram Nath Kovind and the warrants of appointment of Sindhu Sharma and Rashid Ali Dar are likely to be issued within few days, the sources said.
They said names of Advocate Wasim Sadiq Nargal, who had served as Senior Additional Advocate General, and advocate Nazir Ahmed Beig have been dropped despite the Supreme Court Collegium having recommended them for appointment as judges in the Jammu and Kashmir High Court.
In a meeting, the Collegium of three senior-most judges, Chief Justice of India Dipak Misra, Justices J. Chelameswar and Ranjan Gogoi had recommended advocates Wasim Sadiq Nargal, Nazir Ahmed Beig and Sindhu Sharma besides Judicial Officer Rashid Ali Dar as the judges of the high court.
The recommendations were made by the then Chief Justice of the Jammu & Kashmir High Court on 24 August last year in consultation with his two senior-most colleagues.
The sanctioned strength of the J&K High Court is 17 Judges including Chief Justice, but presently there are only 8 Judges. These included Justice Ali Mohd Magrey, Justice Dhiraj Singh Thakur, Justice Tashi Rabstan, Justice Janak Raj Kotwal, Justice Sanjeev Kumar Shukla, Justice M K Hanjura and Justice Sanjay Kumar Gupta besides acting Chief Justice Alok Aradhe.
Last month, the Supreme Court Collegium also recommended acting Chief Justice of Delhi High Court, Gita Mittal for appointment as the next Chief Justice of the J&K High Court.
The office of Chief Justice for the J&K High Court has been lying vacant since March 15this year after the retirement of Chief Justice Badar Durrez Ahmed.
Born in economically backward Brinjan village of Chadoora Tehsil in Budgam district, Rashid Ali Dar had his earlier educatio in the local area up to primary classes in village Brinjan. He did his graduation at Amar Singh College in 1977-78 and L.L.B from University of Kashmir in 1980.
He joined BAR in May 1980, practiced in Munsiff Court Chadoora District Court Budgam, District Court Srinagar and High court up to June 1984.
Rashid Ali Dar had been president of Bar Association Chadoora up to June 1984.
He has been petitioner in two P.I.L’s as a legal practitioner distribution system was challenged being discriminatory in nature against villages who had been given less quota of rice than city residents and electricity tariff.
He had been founder / chairman of N.G.O Green Peace J&K Srinagar and human right society.
He qualified combined competitive examination in 1984 and joined Administrative Service, commonly known as K.A.S in June 1984. Has undergone training of revenue matters/ accountancy and about various managerial skills during probation.
He left Administrative Services in January 1987 and joined K.C.S judicial worked as Munsif Mahore district Reasi, Munsif Sumbal district Bandipora, Munsif Udhampur, Ist Munsif in Jammu, Munsif Chadoora, Munsif Sub-Registrar Srinagar, Munsif Pulwama and Munsif Bandipora.
He was promoted as Sub-Judge in 1996 and joined as sub-judge Ramnagar, sub-judge Wakf J&K, Deputy Registrar High Court Srinagar, Sub Judge/Chief Judicial Magistrate Budgam, City Judge Srinagar, Chief Judicial Magistrate / Sub Registrar Srinagar and Sub Judge / Chief Judicial Magistrate Anantnag.
He was promoted as District Judge in April 2007 and worked as Special Judge TADA/POTA 2nd Additional District and Session Judge Srinagar and Special Judge Anti Corruption.
He has passed number of judgments from Munsif up to Principal District and Session Judge covering various fields. He passed judgment of convection as special judge Anti-corruption and ordered for confiscation of property acquired out of proceeds of crime was almost first of its nature in state.
Advocate Sharma cleared LLB in 1996 from Punjab University, Chandigarh in first division, BA (Hons) in 1993. She was elected as Vice President of J&K High Court Bar Association Jammu in 2013.
