SRINAGAR: Terming the United Nations Military Observers mission in Kashmir as one of extreme importance, the chairman of the Hurriyat (G), Syed Ali Shah Geelani, on Wednesday said that the Shimla Agreement could not override the UN mandate.
Since the Kashmiri people have not been included as a party in the Shimla Agreement, the latter neither makes the UN Observers Mission irrelevant, nor alters the status of the Kashmir issue, Geelani said in a statement from Delhi.
Attributing the Kashmir issue to the forcible occupation of the region by India, Geelani said that the occupation would have been unjustified and a violation of international law even if New Delhi had not gone to the United Nations and even if the world body had not passed 18 resolutions on the question.
When India was fighting for its freedom from the British, it did not have any United Nations backing it, and neither had Britain signed any international agreement about granting India the right to determine its own future, he said.
The right to freedom of the Kashmiri people will not lapse even if the UN recalls its Observers mission from here, nor will Kashmiris give up their struggle, he said.
