Meanwhile Son of Policeman, Who died On Duty, Languishes  in Jail

SRINAGAR:- Family members of a journalism student, who is currently lodged under draconian Public Safety Act (PSA) in the Central Jail, Srinagar have demanded his immediate release on the health grounds.

Tahir Ahmad Mir (24) son of Habibullah Mir, resident of Plan, Bandipore was arrested from his residence during the summer uprising of 2016.

Tahir has completed almost six months in jail. He was first lodged in Kot Balwal Jail in Jammu and was shifted to Central Jail Srinagar for his exams on the court orders.

There are 13 FIR’s registered against him for organizing pro-freedom rallies in Bandipore town during the summer uprising of 2016.

Tahir’s sister Rena, who is fighting his case said: ”My brother has developed stomach ailment besides back disc problems in the jail and his health conditions is deteriorating day by day,”

She also said Tahir has already missed the 2nd semester examination due prolonged detention.

“He wants to carry on his studies but Government has put breaks on his carrier. What will happen with his detention? He will become more resilient,” his brother Abid Mir told Kashmir Observer.

Tahir, an orphan lost his patents at the early age. His father was a policeman who was killed in the line of duty and his mother couldn’t bear the shock after few months of her husband’s death she also passed away. He is looked after by two brothers and a sister.

“My elder brother is a policemen and his posting is in a remote area of the valley due to which he is unable to fight the case. Another brother is running a grocery store and looks after home, so there was no one to fight the case, I decided to take the responsibility,” said Rena.

“He has not pelted a single stone, he was very mush against it, authorities could have counselled him but they deliberately went for harsher treatment,” Rena said.

Talking to Kashmir Observer Advocate Mian Abdul Qayoom who is pleading Tahir’s case in the court said, ‘’His PSA writ petition filed by previous Adv B.A Tak was dismissed by Justice Ali Mohammad Magray some days ago. Now Bar has taken the case and we are going to file another writ petition soon and hopefully it will be quashed,”

Pertinently, Tahir was an employee in Education Department working as laboratory bearer. He was terminated from his services following his detention last year.

Family fears if court quashed his PSA, police can slap another one on him and he might be shifted to back to Jammu.

“He might be shifted to Jammu if another PSA was slapped on him as his exams are also over, it will be very difficult for him to stay in a high temperature and we also can’t visit there, so we are appealing the authorities to release him on the humanitarian grounds,” his sister said.

A group of students and his friends from Kashmir University while demanding the immediate release of Tahir appealed Chief Minister, Mehbooba Mufti, Education Minister, Altaf Bukhari to look personally into the matter so that he can resume his academics.

Few days agoTahir was brought to Kashmir University in handcuffs to sit in an examination. This picture went viral on social media.

“He was handcuffed and escorted by six policemen. Some cops stayed outsid while one sat behind him in the examination hall, holding the handcuffs while he wrote his paper on ‘Peace Building and Conflict Mitigation.’ “Call it irony? Nah! The brutal reality of occupation it is,” wrote his friend Aaqib Hyder on facebook.

One of his friends while condemning his detention wrote on his Facebook wall, “Such an innocent, intelligent and a motivational guy being treated as if he is a criminal. What has he done? Can the Administration explain? And why isn’t his PSA quashed yet? Wrote Shahid Shahri.

Minister for Rural Development Law and Justice, Abdul Haq Khan in a recent meeting told law officers, Police agencies, Public Prosecutors and other officers of Prosecution Wing of the JK Police Department to use PSA on the stone pelters and students in rare cases.

Haq Khan said, “Slapping PSA is embracement for the government, If you arrest anybody which is threat to law and order try to book him under sections and avoid slapping PSA.”
