Jammu: Jammu Kashmir High Court Friday directed Ministry of External Affairs Government of India to make a further request to the High Commission, the Islamic Republic of Pakistan in New Delhi to verify the particulars of Rubeena, who claims to be the citizen of Pakistan and is presently languishing in Jammu jail.
The Court of Justice Ramalingam Sudhakar also directed the Inspector General of Police (Prisons) Jammu to take a passport size photograph of the detenue (Rubeena) and forward it the competent officer in the Ministry of External Affairs, Government of India, in a sealed cover, so as to transmit to the High Commission, the Islamic Republic of Pakistan in New Delhi for appropriate verification of the detenues (Rubeena) claim as to whether she is from Pakistan or not.
The case of Rubeena and her minor daughter who have been held in different jails in Jammu for four years, according to news agency CNS was listed for hearing on Friday. The counsel for petitioner Advocate Shah Ashiq Hussain pleaded for her deportation but the Public Prosecutor stated that the Pakistan high commission has refused to confirm her nationality as a result her deportation has been delayed.
Advocate Shah Ashiq Hussain said from the verification it gets proved without doubt that Rubeen is a resident of Hyderabad in Pakistans Sindh province who travelled to New Delhi in November 2012 for the treatment of asthma. She was accompanied by her husband and her daughter, who was then four months old. He said that her husband abandoned her in New Delhi and disappeared with money and passport. When Rubeena was abandoned by her husband, people gave her money and sent her to the Wagah border crossing but Pakistani authorities did not allow her to enter the country because she did not have travel documents. Rubeena was then sent to Kashmir, where she was arrested in November 2012.
After listening to the arguments, Justice Ramalingam Sudhakar directed the External Affairs Ministry Government of India to take up her case again with the Pakistani Mission in New Delhi. The court also directed authorities to send a trained lady Psychiatrist either from Srinagar or Jammu who could visit the detenue and ascertain her conditions and suggest measurers to help her till the issue is resolved.
