Srinagar: The J&K High Court Thursday upheld Chief Judicial Magistrate Srinagar’s direction to lodge FIR against DySp and policemen in connection with the murder of a city youth on July 10 last month.
The verdict was announced by a single bench of the court comprising Justice Mohammad Yaqoob Mir.
Dismissing the petition (561) (A), the High Court asked the police to register and FIR against the accused police officer and others mentioned in the petition. The petitioner was represented by Advocate Zaffar Ahmed Qureshi and Advocate Zahoor Ahmed Bhat.
Earlier the court of CJM Srinagar Masrat Shaheen had directed the SSP Srinagar to register an FIR against a Deputy Superintendent of Police Yasir Qadri in connection with the killing of Tengpora youth Shabir Ahmed Bhat.
The CJM on July 18 had directed SSP Srinagar to file an FIR against DySP Yasir Qadri and other police personnel on an application filed by father of Shabir Ahmad Mir, who was allegedly killed inside his house at Tengpora in Batamaloo area on July 10.
The government had challenged the CJM order in the High Court. However the High Court on Thursday upheld the verdict of CJM and directed the police to lodge an FIR against the accused police officer.
Pertinently, the applicant had submitted that on July 10 at 6:45 pm when they were watching television, a police party headed by DySP Yasir Qadri barged into their house and started smashing windowpanes and doors of the house. The wife of the applicant tried to stop the said police officer, however he physically assaulted her. The son (deceased Shabir Ahmed Mir) could not tolerate the thrashing of his mother and tried to rescue her from the clutches of the police officer. The Police officer took out his pistol and fired two shots at him resulting in his on spot death.”
“The applicant had further submitted that the said DySP took law in his own hands and killed his son in cold blood without any reason and rhyme. The applicant has submitted that he filed an application with the SHO Batamaloo who refused to lodge an FIR against the said DySp.”
