SRINAGAR (ONS) – Clarifying that he was not opposed to maintenance for divorced Muslim women, Justice (retd) Basheer Ahmad Kirmani on Tuesday said that his petition for a review of the High Courts ruling on talaaq was to arrive at a correct interpretation of the Quran and the Hadees in view of the Bilquees Banu case.
I have not touched the maintenance issue in the petition, but have prayed for a revision of the court decision which has interpreted the Quran and the Hadees out of context, Justice Kirmani said.
My objections are not to the maintenance issue but to the conditions of divorce, he said.
The intention of the ruling might be to make it difficult for a man to divorce his wife, but divorce should not be made so difficult as to turn the life of a person into hell, he said.
Kirmani asserted that coming times would witness a significant decline in the incidence of divorce.
Today, half of ones lifetime earnings are spent on entering the marriage contract, and if it comes to divorce, the other half would be spent on that, he said.
Such a situation will make people think twice before opting for divorce, he said.
