Jammu: The much publicized case of Public Interest Litigation (PIL) filed by a social activist against land grabbing of land by politicians, police and bureaucrats in league with land mafia took a new turn on Friday when a family accused a former Congress minister of occupying 342 Kanals of
Their land in the city outskirts.
The land (Khasra No.1, Village Chak Lallo Shah, Jammu) near IVth Bridge, Jammu in Niki Tawi Area is claimed by Kamni Gupta, Geeta Gupta, Archana Gupta, Laxmi Gupta and Romi Gupta daughters of Late Hem Raj and Chanchal Gupta widow of Late Hem Raj residents of Partap Garh, Jammu.
They filed a Miscellaneous Petition in WPPIL No.19/2011 in the State High Court seeking restoration of their possession on the land which is under the illegal occupation of three daughters of former PHE/ Health Minister Taj Mohi-ud-Din.
In the petition filed through Advocate S.C. Gupta it is submitted that the issue of land grabbing by politicians, police officers, bureaucrats in league with land mafia is pending before the Division Bench in PIL titled Prof. S.K. Bhalla V/s State of J&K & Others and the applicants are suffering at the hands of influential politician former PHE/ Health Minister and are seeking intervention through the present petition.
It is further stated in the petition that the applicants are lawful owners as share holders of land and the land is reflected in unlawful occupation (Kabza Na-jaiz) of Ms. Shabnam Taj, Nousheen Taj and Arshi Taj daughters of Taj Mohi-ud-Din former PHE/Health Minister J&K Government. The applicants have further submitted that in para 18 of the PIL the whistleblower has highlighted the brazen case of land grabbing of proprietary land of the applicants by none else than the three daughters of Taj Mohi-ud-Din. The revenue record of the above referred land fully demonstrates that the land is duly owned by two brothers Tilak Raj and Hem Raj (Uncle and Father of the applicants) but at present the Khasra Girdawari reflects the illegal occupation of three daughters of Taj Mohi-ud-Din.
The applicants in the petition according to CNS have further submitted that the recorded occupants i.e. the daughters of Ex-Minister are in fact benami and real actor is Taj Mohi-ud-Din who is highly influential person and former Cabinet Minister. The matter was complained and brought to the notice of the officials of Revenue Department by the predecessors of the applicants but the result was disappointing and to the misery of the applicants the Minister continues his wrongful occupation.
The applicants have prayed in the miscellaneous petition that they be permitted to intervene in the matter and appropriate directions be issued to the enforcement agencies i.e. Revenue and Police directing them to liberate the land in question from unlawful occupation of Ex-Minister Taj Mohi-ud-Din and his three daughters.
