Case again listed on April 17, locals hail judicial intervention
Srinagar- The High Court of Jammu & Kashmir and Ladakh has come to the rescue of villagers of Brenwar in tehsil Chadoora of district Budgam as their demand for holding a fresh election for the village Numberdar has been accepted by the top court.
The bench of Justice Wasim Sadiq Nargal in an order issued on March 6th 2023 has directed the Secretary Revenue , Divisional Commissioner Kashmir and Deputy Commissioner Budgam to consider holding elections for the Numberdar in Brenwar village in 28 days.
“ Respondents are directed to accord consideration to the representation alleged to have been filed by the petitioners for holding election for the post of Lumberdar (Numberdar) in terms of Lambardari Act and rules framed thereunder within a period of 4 weeks. The consideration order which is likely to be passed be placed on record while filing the response” reads the order
Pertinently braving inclement weather, residents of Brenwar village of Chadoora Tehsil in central Budgam district had held several protests during the month of January and February against the Numberdar of village Saifudin Jahara alias Chowdhary who has been holding the post for last around 30 years. The locals have been alleging that the said numberdar was corrupt and was mistreating the people. The villagers had held a massive protest not only in the village but in Press Colony Srinagar as well on several occasions. The locals have welcomed the order of the High Court
“ We welcome the order of the High Court and hope that DC Budgam will hold fresh elections within the stipulated time of 28 days from the date of issuance of the order (March 6th 2023). We are being harassed on a daily basis by the Numbderdar whose son in order to save his skin has joined the BJP. He is now trying to harass local Govt employees calling them political workers. We appeal to the BJP leadership to understand the evil designs of these people. They have switched their loyalties to almost four political parties in the last 30 years. They were with Congress in 1980;s , then National Conference in 1990’s and when PDP came to power , they joined PDP and then Peoples Conference and now BJP. Their sole motive is to harass people and hide their misdeeds. Finally the judicial intervention has helped us” said a local of Brenwar Ghulam Qadir
Pertinently as per SRO 412 dated 29th September 2017, government had reduced the age limit of Numberdar to 25 years and maximum limit to 60 years. The Petitioners from Brenwar in their petition filed before the High Court said the Numberdar Saifudin Jahara was above 60 years and was not eligible to continue.
