Jammu- The Central Administrative Tribunal -CAT has given last opportunity the counsel of the respondent as he failed to file the response in the matter titled Ajay Kumar v/s J&K Higher Education Department. The CAT bench of Ram Mohan Johri and Rajinder Singh Dogra on Thursday in an order gave last and final opportunity to Advocate Rahil Raja the counsel for the respondent namely Mohammad Qasim Mir. The bench also warned of stern action if the response was not filed within stipulated time of for weeks.
Details available reveal that J&K Higher Education Department had appointed one Mohammad Qasim Mir S/o Mohammad Raqib Mir a resident of District Poonch as Assistant Professor Geography in 2021. The aggrieved Ajay Kumar R/O Kerimanyalla Rajouri who had been dropped from the selection list had moved to CAT after obtaining information regarding the various certificates / ALC certificate issued in favour of Mohammad Qasim Mirunder RTI Act. The information was sought from JK Public Service Commission , Govt Degree College Mendhar , Tehsildar Mendhar and the same were submitted before CAT Jammu bench along with the petition in 2021.
The aggrieved candidate had moved to the District Court Jammu which passed an order on 30-03-2024 instructing Crime Branch Jammu to register FIR against Mohammad Qasim Mir, but the order was stayed by J&K High Court. The CAT meanwhile was following the case separately and on 17-10-2024 it passed an order providing final opportunity to file objections with warning. The CAT Jammu bench order reads :
“Despite granting various opportunities to the respondents, they have failed to file the reply. Four weeks’ time as a matter of last opportunity is granted to Mr. Rahil Raja, appearing on behalf of respondent, to file the reply, failing which the erring official shall remain present before this Tribunal on the next date of hearing along with records and explain why reply has not been filed till date and the coercive action shall not be initiated against them.”
