Srinagar- Citing inability on the part of the police to handle the case, a lady who claims to have suffered domestic abuse at the hands of her husband, has lodged a complaint with the Lieutenant Governor’s Grievance Cell to have her grievance redressed.
Tasneem Ruhi, wife of Lateef Ahmad Badyari according to her family was brutally assaulted and injured by her husband at her matrimonial home in Chandpora, Harwan area of the city last month.
The accused was arrested the same day following a complaint by the victim at the concerned police station under the Protection of Women from Domestic Violence Act 2005.
The victim, according to her family, suffered severe injuries after being struck on the back of her neck by her husband before dragging her out of her matrimonial home.
A formal case FIR no 29 of 2024 under section 498-A of Indian Penal Code (IPC) stand registered at police station Harwan in this regard and investigation underway.
A senior police official informed Kashmir Observer that the accused was taken into custody the same day the crime happened. He said an FIR was lodged after the victim recorded her statement before the officer investigating the instant case.
The family of the victim, however, has claimed that the police have miserably failed to take any action against the guilty allowing him go scot-free.
“The incident occurred more than a month ago, but the police haven’t been able to take any action against the accused, therefore we filed a complaint with the LGs Grievance Cell. In the complaint, we have detailed the entire incident in addition to the police’s inability in handling the case,” they told Kashmir Observer.
They hoped that the police will be directed to follow the Supreme Court of India’s established guidelines in handling this matter, and that the accused will be dealt with in accordance with the law.
Upon contacting the SHO Harwan police station, this reporter was informed by someone claiming to be his subordinate that he was unwell and could not talk.
However a senior official later said the accused was arrested the same day his wife filed a complaint against the accused at the concerned police station. He said the police have no authority to continue the detention of an accused out on bail by the court.
“The accused was taken into custody as soon as his wife filed a domestic abuse complaint. However, detention of an accused ends when the court grants bail, and police cannot violate the Supreme Court’s established guidelines in the DV Act,” he added.
