Srinagar- A court here has sentenced a man from Srinagar to two years in jail and directed him to pay fine of Rs 8250000, one and half of the dishonoured amount, in three cases of cheque bounce.
According to the complainants, dealing in the sale of golden items and ornaments, the accused person had purchased golden items from their shops and issued various cheques against the amount. However all the cheques came to be dishonored and returned to the complainant without payment by the concerned bank.
Consequently, the complainant filed complaints interms of Section 138 of the N.I. Act in 2015.
“The complainant has been able to prove the commission of offence under section138 by the accused Hilal Ahmad Khan R/O Hussani Public School, Industry Area H.M.T Batamaloo, Srinagar for which the accused is hereby convicted,” said Third Additional Munsiff, Moneer Ahmad, adding, “.. by commission of the offence the accused person has dragged the complainant to litigation which is pending for the last more than seven years.”
Consequently the court ordered that the “accused is punished for two years of simple imprisonment and he is fined Rs.37,50,000, which is one and half of the cheque amount to be payable to the complainant.”
The court also convicted and sentenced the accused to 2 years jail in another case and fined Rs.22,50,000, one and half of the cheque amount.
Similarly, the court also sentenced the accused to 2 years in jail and imposed Rs 22,50,000 (one and half of the cheque amount) in the third case.
“In case the accused fails to pay the fine so imposed the complainant would be free to choose any remedy available under law to recover the same, including issuance of levy warrant against the accused person,” the court added. Similar order was passed in two other cases.
