Prosecution Says Drug Trade Serious, Needs To Be Dealt With ‘Iron Hands’

Srinagar- A court here rejected bail application of a ‘drug peddler’ who according to police was arrested with 360 bottles of Corex (codeine phosphate) on 31 August last year from Parimpora area of Srinagar.
While declining the bail plea of the accused, Bashir Ahmad Bhat of Maloora Srinagar, the court of 3rd Additional Sessions Judge Srinagar Sandeep Kour said where public interest would be defeated, personal liberty has to be curtailed by established process and procedure of law.
“…while granting bail, interest of the public is to be considered and on weighing the personal liberty and public interest, if there are grounds that public interest would be defeated and personal liberty has to be curtailed by established process and procedure of law, the bail can be declined,” the court said while referring to a judgement of the Supreme Court.
“It is a settled position of law that liberal approach in the matter related to the narcotic drugs and psychotropic substances is uncalled for,” the court said and rejected the bail plea.
While counsel for the accused said that his client was “innocent”, the prosecution had resisted the bail application.
In its objections to the application, the prosecution stated that the accused was involved in grave and heinous offence and as such he was not entitled to the concession of bail. It said 360 bottles OF Corex (Codine Phosphate) of 100 ML each were recovered from the possession of accused which falls within the purview of commercial quantity, and carries imprisonment which extends upto 20 years besides fine to the extent of two lakh rupees. It said accused was in the trade of selling the drugs to the youth which definitely is a matter of concern as such demands rejection of the bail application at this stage. “The accused is involved in the commission offences which are totally heinous and crime against the interests of the society and the same is to be dealt with iron hands”.
The court, the prosecution said, is the guardian and custodian of the rights and interests of the society as such in order to uphold the majesty of law and to maintain the confidence of law abiding citizens in the justice delivery system the application for bail of accused deserves to be rejected.
