Uri- A court here has rejected bail application of three “habitual” burglars.
“I have perused the bail application, objections from the prosecution and the case file. A bare perusal of the documents reveals that the accused are prima-facie involved in case FIR no. 02/2022 for the commission of offences under sections 457&380 of IPC,” Court Of Munsiff/Jmic, Boniyar, Muneer Ahmad Bhat said, “Further the involvement of the accused in multiple FIRs in different police stations clearly indicates that the accused persons are habitual offenders.”
The presiding officer Muneer Ahmad Bhat said that the court was duty bound to keep in view theunderlying factor behind the concept of bail—“balancing of conflicting interests of sanctity of individual liberty and the interest of the society.”
“Therefore, in order to uphold the majesty of law and to maintain the confidence of law-abiding citizens and law enforcing agencies in the justice delivery system, the application for bail of the accused deserves to be rejected,” the court said as per GNS and rejected bail plea of Altaf Ahmad Sheikh of GantamullaPayeen Baramulla, Parvaiz Ahmad Sheikh of Kitchema Tehsil Narvaw Baramulla and Mohammad Lateef Pathan of Lailub Mujpathri Khansahab Budgam.
