SRINAGAR The state government has ordered sanction for launching of prosecution under Unlawful Activities (Prevention) Act against octogenarian leader of Hurriyat Conference (G) Syed Ali Shah Geelani along with ten others in a case registered in 2009.
According to a government order issued here by the states home department headed by governors advisor K Vijay Kumar, has come to definite conclusion the case was a fit one for accord of prosecution sanction against them for commission of offences punishable under Section 13 of the Unlawful Activities (Prevention) Act, 1967; and
As per the order, on 11 December 2009, Police Station Khanyar, received a written docket from SHO Police Station Khanyar that a procession led by Mohammad Shafi Lone, Peer Saifullah, Mohammad Shafi Reshi under the command of Syed Ali Geelani came out from Zeyarat Naqeshband Sahib and raised anti- national slogans and violated Section 144 Cr.PC, banning assembly of more than ive persons. It says the notification under 144 CrpC was issued on 9th December 2009 by District Magistrate Srinagar. A case FIR No. 84/2009 U/S 188 RPC 13 ULA Act was registered at Police Station, Khanyar and investigation was taken up, the order reads.
During investigation, press cuttings having bearing on the case were obtained as piece of evidence and placed on file. Evidence oral and documentary collected during investigation substantiated the involvement of accused persons, it said.
Besides Geelani, the other accused Irshad Ahmad alias Irshad Majeed Sofi son of Abdul Majeed Sofi of Zahidpora Hawal, Abid Showkat Mir son of Showkat Mir of Zandar Mohalla, Mudasir Ahmad Teli son of Nazir Ahmad of Guzar Masjid Srinagar, Manzoor Ahmad Khan son of Ghulam Hassan of Aqlimar Khanyar A/P Elahibagh, Bilal Ahmad Badyari son of Abdul Majeed of Batwara Srinagar, Ghulam Nabi Malik alias Sadam son of Abdul Ahad Malik of Shahlal Handwara A/P Brathna Qamerwari, Mushtaq Ahmad Sheikh son of Ghulam Mohiddin of Syedpora Nowhatta, Peer Saifullah alias Bashir Ahmad of Zadoora Pulwama , Mohammad Shafi Lone son of Abdul Aziz of Bishambernager Khanyar, Mohammad Shafi Reshi son of Ali Mohammad Reshi of Nesbal Sumbal A/P Dalgate .
As per government, seven accused have been arrested in the case while as Geelani, Peer Saif-ullah and Mohammad Shafi Reshi have not been arrested being extreme elderly.
It has been proposed that they shall be presented before the competent court of law at the time of presenting charge sheet, it said.
It said the Authority appointed by the State Government under sub-section (2) of section 45 of the Unlawful Activities (Prevention) Act, 1967, has independently scrutinized the Case Diary file and all the other relevant documents relating to the case and has come to a definite conclusion that this is a fit case for accord of prosecution sanction against the accused persons for commission of offences punishable under Section 13 of the Unlawful Activities (Prevention) Act, 1967.
