SRINAGAR The Jammu and Kashmir High Court Wednesday issued a notice to government of India and BSNL to remove the Mobile Tower which has been installed or erected in close proximity of NTPHC (New Type of Public Health Centre) at Batalik Kargil.
A division bench of the court issued to notice after hearing the advocate Syed Manzoor Ahmad, counsel for the petitioner Mohammad Habib , a resident of Batalik which is the most backward pocket of the state.
The petitioner has sought directions to the authorities to reinstall or relocate the towers as per the norms and guidelines of DoT.
The petitioner has also sought directions Chief Medical Officer Kargil and Airtel to restrain them from installing the Mobile Tower in the proximity of NTPHC (New Type of Public Health Centre) Batalik, Kargil. Also direction has been sought to them to strictly adhere to the norms and guidelines issued by DoT
The petitioner, a Post Graduation in Chemistry and a social activist said that petition is of vital importance government have installed Mobile Tower in close proximity to NTPHC (New Type of Public Health Centre) Batalik, without obtaining NOC from respondents Tele communication District Manager Leh and LAHDC and also from the local residents of Batalik.
That the instant petition is filed because of public concern growing in the locals of Batalik over possible hazardous health effects viz: cancer and other diseases, from EMR (Electromagnetic Field Radiation) exposure from BT5 antena and mobile tower installed adjacent to the NTPHC Batalik, he said.
The mobile tower installed by BSNL adjacent to NTPHC Batalik is violative of rights enshrined in Part-III of the constitution of India, he said.
The action of the respondents is illegal and is adversely affecting the health of the locals who are not in a position to protect their own interest on account of poverty, incapacity and ignorance, he said.
