SRINAGAR The government on Thursday said a worrying situation has been created for the State by departments and their Counsels for not filing appeals before courts expeditiously.
After putting in an extensive labour in grant of sanctions for filing Appeals/LPAs/SLPs, it has been observed that these petitions are not being followed/filed by the departments/Counsels representing the departments before the Courts expeditiously, Secretary to government, law department, said.
This has created a worrying situation for the State, the secretary said, adding, The delay in filing these petitions is viewed very seriously by the Courts and more often the cases are dismissed at the condonation of delay stage, which state of affairs State cannot afford to perpetuate.
In order to overcome such a difficulty, the government has enjoined upon all the Administrative Secretaries/HOD’s to ensure filing of Appeals/LPAs/SLPs within a period of 10 days from the date of grant of sanction otherwise matter may be placed before Competent Authority for appropriate action under rules.
Meanwhile, the government has also asked Administrative Secretaries and HODs not to engage counsel on their own and consul law department henceforth.
It has been noticed that various departments/corporations are engaging Standing Counsels before the subordinate courts and High Court of its own without consulting Law Department which has created an anomalous situation effecting the interests of the State, the secretary said, adding, In order to overcome this practice, it is enjoined upon all the Administrative Secretaries/HOD’s not to engage standing counsels of their own without consulting Law Department henceforth.
