SRINAGAR A local court in Srinagar convicted a man in a cheque bounce case awarding him one year imprisonment after the accused was found guilty for cheating a city man.
Observing that dishonest drawers of cheques defeat the very object of Negotiable Instrument Act, Court of 2nd Additional Munsif FH Iqbal sentenced Noor-ul-Hussain Khan of Ghulab Srinagar to one year imprisonment after he was found guilty of cheating in a cheque bounce case.
The court also directed the covict to pay compensation in terms of Section 545 CrPC to the complainant amounting to Rs 15 lakh to compensate the suffering and the harassment besides the legal expenses incurred by the complainant for no fault of his.
In 2012, one Muhammad Yakub Zargar of Khan Mohalla Bagahat Srinagar filed a complaint against Noor-ul-Hussain Khan issued a cheque up to the tune of Rs 12 lakhs to him to liquidate his liability.
Zargar, through counsel Advocate General SA Rathore, pleaded before the court that the cheque was dishonoured by Bank while the convict used dilly dally tactics to clear his liability.
Besides one year imprisonment, the court also directed the convict to pay one lakh fine to the petitioner.
Ironically, when the court awarded the sentence, the convict manage to escape from the court and till date he is not traceable.
Man sentenced to 6 months jail
Judicial Magistrate Pampore Fozia Paul convicted a man in a cheque bounce case awarding him 6 months imprisonment and fine to the tune of Rs 6 lakhs after the accused was found guilty under section 138 of Negotiable Instrument Act. Observing that dishonest drawers of cheques defeat the very object of Negotiable Instrument Act, Court of Judicial Magistrate Pampore, Ms Fozia Paul sentenced Ghulam Mohidin to 6 months imprisonment after he was found guilty in a cheque bounce case.
The court also directed convict to pay compensation to the complainant amounting to Rs 6 lakh to compensate the suffering besides the legal expenses incurred by the complainant for no fault of his.
In 2015, one Farooq Ahmed Mir resident of Hatiwara Lethpora through his Advocate Fayaz Ahmad Lone filed a complaint against the accused as accused had issued a cheque for an amount of Rs 3.0 Lacs in order to liquidate the liability
