SrinagarThe Jammu and Kashmir High Court has directed fee fixation panel to consider a plea by some private schools to hike school fee by 15 percent.
Disposing of four petitions, seeking directions to Committee for fixation of fee structure of the private educational institutions may be directed to consider and decide representation filed by them regarding enhancement of fee structure.
The institutions urged the court that the Committee may be commanded to allow the revision in the fee structure of the petitioner schools by 15% strictly in accordance with the judgment of Supreme Court with effect from the academic year 2017-18.
Counsel appearing for Tyndale Biscoe & Mallinson School, advocate Sunil Sethi, submits that the they would feel satisfied in case the Committee be directed to consider representation of the Schools as have already filed them on 5 June this year with a further direction to consider revision of fee structure by 15%.
With the consensus of counsel for the parties, all the four petitions are disposed with a direction to the (Committee) to accord consideration to the representation of the (schools) and to take decision thereon whatever permissible preferably within a period of 15 days. In the process enhancement of fee structure by 15% be also considered, said a division bench of Justices Mohammad Yaqoob Mir and Ali Mohammad Magrey.
In 2015, the government appointed Justice (Retd) Hakim Imtiyaz Hussain has as chairman of the fee-fixing panel for schools with a view to regulate the fee structure of private educational institutions in the state.
It is well settled now, as has been laid down by the Supreme Court of India in a catena of authorities that commercialisation and exploitation is not permissible in the Education Sector, Justice (retd) Hussain has said in his message soon after assuming the charge.
Education is treated as a noble occupation on no profit-no-loss basis. Thus, those who establish and are managing the Educational Institutions are not expected to indulge in undue profiteering or commercialise this noble activity, he said.
