Srinagar: Calling him mentor of stone-pelters and threat to economy, Government has slapped Public Safety Act (PSA) on a shopkeeper who protested and helped a woman tie a stalker cop accused of taking her pictures recently in the Manigam area Ganderbal district in central Kashmir.
The District Magistrate Ganderbal passed order under PSA on Muhammad Shafi Khan son of Ghulam Hassan Khan of Yarmuqam Lar, Ganderbal.
According to the dossier prepared by the DM, Khan was responsible for creating disturbed atmosphere in the area of Manigam Ganderbal by such nefarious act.
The DM said that the shopkeeper was involved in case FIR No. 219/2017 under sections 147, 341, 342 RPC, 18 ULAP Act of police station Ganderbal.
On 14-10-2017, a police party from police station Ganderbal reached Manigam Bypass at about 10:30 hours and found a uniformed policeman tied by a rope with a chair.
The gathering raised anti-national and pro-Pakistani slogans. The NHW-1 was blocked by the gathering. (Khan) was found leading the protests and raising anti-national and pro-Pakistan slogans in favour of militant Zakir Musa and (he) created law and order problems on the day. The uniformed policeman was rescued and the vehicular movement restored.
Reportedly, (Khan) has beaten the uniformed policeman on the road. The case has been registered against (Khan) and others, investigation of the case is going on, reads the dossier, according to news agency GNS.
The shopkeeper, as per the dossier was also involved in other cases of law and order in the dossier. As per the PSA dossier, he has been declared involved in case (FIR No. 164/2016) under sections 148, 149, 307, 341, 336, 427, 332 RPC of police station Ganderbal. On 1-08-2016, an unlawful mob came out on the general road and pelted stones upon vehicles.
The police party/ others paramilitary forces reached on the spot and tried to disperse the unlawful mob peacefully, but the subject and unlawful mob started stone-pelting on the police party/ others paramilitary forces, resulting in the injuries to police personnel and damaged ambulance bearing registration No. JK0AG-9392 and ambulance bearing registration No. CH-1292 from PHC Wussan and SDH Kangan respectively. The above mentioned case has been registered in police station Ganderbal against the subject and others, it reads.
The DM in the dossier called the Khan a chronic trouble monger. The activities of the subject have been creating disturbance in maintenance of public order. The subject either directly or indirectly has been found involved in almost all the stone-pelting incidents on NGW-(Bypass)/Manigam areas.
The subject not only headed the unlawful mob but also acts as counselor and mentor to the stone-pelters by playing a lead role and fuelling such violent processions. The activity of the subject has even affected economy of the State and educational career of the students. The subject has been specifically identified/ involved in the above mentioned cases. If allowed to remain at large will adversely affect the maintenance of public order, the dossier claims.
It further reads that “he has developed his contacts with the like-minded people affiliated with anti-social elements. He is encouraging and instigating youths of the area to create law and order problems”. “The subject is playing a lead role in stone-pelting on government, police, paramilitary forces, private vehicles at every opportunity in the district, especially on Srinagar-Leh National Highway (Bypass), Manigam, Lar etc,” the dossier reads.
The activities of the subject are prejudicial and detrimental to the maintenance of the public order. The detention of the subject under the relevant provisions of the J&K Public Safety Act has thus become imperative as the normal law is not sufficient to stop the subject from indulging in the activities which are prejudicial to the maintenance of public order, the PSA dossier of Shafi prepared by DM Ganderbal reads.
Under draconian PSA any one in Kashmir can be jailed without trial for upto two years.
On October 14 a policeman was detained for allegedly clicking pictures of a woman while she was standing at Manigam Bypass and after her objections had mobilised onlookers who caught and tied the cop till police arrived on the scene.
The policeman, who was disguised as a commoner, was tied to a chair.
“One girl gave statement in police station that her pictures were allegedly clicked by a cop. We have immediately registered an FIR in this case, Fayyaz Lone, the Senior Superintendent of Police (SSP) Ganderbal had said.
SSP Lone had further said that strict actions will be taken against the cop, “We have taken actions against him and he has been arrested. Law will definitely take its course. The accused cop has since been let off.
