SrinagarThe Jammu and Kashmir High Court on Tuesday directed Crime Branch to file updated status report of its ongoing investigation of scam in Elementary Training Colleges in the state.
Hearing a Public Interest Litigation, a division bench headed by Justice Badar Durez Ahmad passed the direction after perusing a latest status report handed over to the court by senior Additional Advocate General B A Dar.
The report indicated that the charge sheet for 2009-11 has been produced in the court on August 21 against 15 accused persons.
The Crime Branch also already filed charge sheet for sessions 2003-05, 2004-06, 2005-06, 2005-07, 2006-08, 2007-09 and 2008-10 before the Special Judge anti-corruption Jammu.
In so far as session 2011-13 was concerned, the report revealed that investigation was going on and that the relevant record has been seized by the investigation officer. It appears that more than 55 ETT institutions were established during the session. The record collected so far is under scrutiny and after completion of the examination of documents, the final view in the matter would be taken, the court said. The senior AAG also assured the court that investigation in so far as session 2011-13 shall be expedited.
Before the next date of hearing, (the senior AAG) shall give also an updated Statius report of the investigation.
In addition, the court asked him to file an updated chart indicating the institution which have been closed and also those institutions which are being permitted.
The Crime Branch has registered two cases (FIR No. 27/2013, P/S Crime Branch, Kashmir and FIR: 36/2013, Crime Branch, Jammu) under 5(2) of Prevention of corruption Act) as well as RPC sections of 420 (cheating), 468 (forgery), 471 (counterfeit seal).
An inquiry conducted by the Board of School Education (BOSE) into the training course by the ETT colleges has already described it a big scandal run by mafia in league with the top brass in the BOSE.
The investigators arrested some officials of the BOSE including its former chairman in connection with the case. They were later released on bail.
The crime branch registered cases on an inquiry report forwarded to it by the J&K State Board of School Education regarding irregularities, sex-exploitation and charging of whopping amounts of Rs 40000-80000 without any regular classes for candidates of ETT colleges in the state.
With regard to the proposed amendment in JK School Education Rules 2010, the senior AAG submits that this may take about four weeks.
