Srinagar: Congress leader and former Finance Minister Tariq Hamid Karra Thursday said that the coalition government has been leaving no stone-turned in harassing him mentally.
He alleged that government has been patronizing and encouraging land grabbers. Land grabbers on the behest of government have been trying to encroach upon my ancestral property at Shivapora Srinagar.
He said that in the year, a suit for declaration and mandatory injunction came to be filed by one Khurshid Ahmed Wani, and others before the Honble Court of District and Sessions Judge Srinagar against the state of Jammu and Kashmir and others which was transferred to the court of Subordinate Judge, Forest Srinagar. In the suit it has been prayed that the land measuring 33 Kanals and 04 Marlas covered under survey no. 224, 30,28, 223, 260, 303, 326 and 225 belonging to Imam-ud-din and others situated at Shivpora, which is under the possession of the petitioner as Manager, has been allotted to the persons of Ghulam Mohammad Wani, Abdul Rashid Wani, Mohammad Yousuf Wani and Khurshid Ahmed Wani of Shivpora Srinagar.
When I came to know about filing of the suit, I immediately approached the office of Custodian General to know the events leading to passing of this order, when the matter is pending before the government for restoration of the property to me and other legal heirs. To my surprise, I found that no such order was ever passed. Accordingly I filed an application before the Deputy Custodian General praying therein that the copy of the order be provided and also show cause as to how such an allotment was made in favour of the persons namely Abdul Rashid Wani and others. On 16th of April 2015 the Deputy Custodian General communicated with the Custodian Evacuee Property that there was no such order passed when in fact order no.181 of 2014 dated 07.07.2014 has been issued in favour of one Mohammad Sarwar Bhat son of Ghulam Mohammad Bhat of Sarai Balla Srinagar in respect of land measuring 1238 Sfts belonging to Abdul Rahim Fouq situated at Shaheed Gunj Srinagar. In the same manner the evacuee land under my Manager-ship measuring 08 Kanals 14 Marlas under khasra no.303 khewat no.11 and land measuring 03 Kanals 18 Marlas under Khasra no.260 and khata no. 12 situated at Shivpora Srinagar was also claimed by Mehraj-ud-din Wani and Mukhtar Ahmed Wani both sons of Asad Wani and Khalil Wani on the basis of fraud entry recorded in the revenue records. They have also on this fraudulent entry initiated civil proceedings which they did not follow and the suit, in which relief for declaration and injunction was prayed, was dismissed, he said.
I approached the Custodian General to hold a detailed enquiry and refer the matter to the concerned Police Station so that culprits including the beneficiaries of this illegal order are booked under criminal law and appropriate action is taken against them. The Custodian General till date has not taken any action nor has the matter been referred to the police, the former Parliament Member said.
Kara said that the civil suit filed against him is a forged and fabricated order issued from the office of Deputy Custodian General. Furthermore, on enquiry conducted it was found that no such order has ever been passed and the number and date of order in fact is of a different order pertaining to a different property situated at Shaheed Gunj Srinagar.
I am one of the legal heirs (son) of Late Kaukab Jabeen, who alongwith other legal heirs namely Mrs Akhter Firdous and by implication of law, succeeded to the property left by the evacuees Imam-ud-din and Qamar-ud-din.
He said that It is ironical on the part of the Custodian General, that he has accorded sanction to the regularization of the land in favour of the persons, who had managed fake and forged orders for the aforesaid land and for which the Honble High Court had directed to report the matter to the police.
