SRINAGAR: Court of Principal District Judge Srinagar Wednesday directed the Treasury Officer, Moving Secretariat to attach the Account Heads being operated by Reyaz Ahmed Bandey, Director General Department of Economics and Statistics. The court has also passed the directions asking authorities to withheld the salary of the said official.
These directions were passed by Court of Principal District Judge Srinagar Rashid Ali Dar. He has also put the respondent Reyaz Ahmed Bandey, Director General Department of Economics and Statistics to notice to show cause as to why he should not be sent to civil prison for disobedience of the court directions.
The respondent Reyaz Ahmed Bandey, Director General Department of Economics according to court flouted the court orders and made a default in having deposition of the amount up to the tune of Rs 113.39.
An application preferred by the applicant under Section 9 of the Arbitration and Conciliation Act, seeking release/securing the revalidated amount of Rs 138.39 lakhs, from the non-applicants on the ground of having become due and payable to him on account of consideration sum for execution of contract works awarded by non applicant department vide allotment dated 24/2/2015 for conducting survey and preparation of Business Register as regards number of Registered Unit Holders under different Statutes, in 11 districts in the state of J&K, stands disposed by this court vide order 29/3/2016 whereby the non-applicants were directed to deposit the revalidated amount of Rs 138.39 lakhs in this court after its withdrawal from the treasury during the currency of this financial year with further direction that necessary orders would be accordingly passed regarding appropriation of the amount or otherwise in the light of development in the case including the finding, if any, returned by the Arbitrator in the proceedings contemplated to be initiated in this regard. The applicant was directed to take necessary steps for getting the arbitrator appointed within a reasonable period of time failing which the non-applicants would be free to approach the court and seek appropriate orders accordingly.
The respondents according to news agency CNS having failed to deposit the said amount in this court, the applicant filed an application before this court seeking compliance of the court order and submitted that instead of depositing the amount in this court have surrendered the same to the Government of India and thus has committed gross contempt of the Order of this Court.
The respondent Reyaz Ahmed Bandey, Director General Department of Economics on being served caused appearance before this court and filed objections to the said application. The respondent appeared before this court in person and stated that Rs 25 lakhs have been already released in favour of applicant and out of the remaining amount and amount of Rs 52 lakhs will be deposited by him in this court up to December 2016 and the remaining amount up to January 2017. His statement to this effect was also recorded, however, he flouted the court orders and became a defaulter.
