There has been a complete breakdown of law and order and a complete failure of constitutional machinery in the state. I fail to understand by virtue of which political authority the present government is still claiming to maintain its political legitimacy in Kashmir. The sanctity of the constitution has been destroyed by the very people who claim to be guardians of the constitution and who have taken the oath of upholding its principles at all times.
The chameleon like approach which has been adopted by the political regimes in Kashmir so far is destroying the very spirit of the constitution. The lacklustre attitude of the central government and the blatant abuse of power by the state government only confirms how power hungry the present political regime is. Instead of owning responsibility the state government is busy playing politics. The constitution which is invoked every now and then to justify the atrocities being perpetrated in Kashmir, was not drafted to give impunity to killers. It was supposed to grant power to a common citizen but it seems both the central and the state governments are no longer interested in upholding the constitutional sanctity.
They are themselves abusing the powers given to them by the constitution of India. Dr. B.R Ambedkar, the father of the Constitution once said, “However good a Constitution may be, it is sure to turn out bad because those who are called to work it, happen to be a bad lot. However bad a Constitution may be, it may turn out to be good if those who are called to work it, happen to be a good”. Sadly, the present central as well as the state governments have diluted the very principle of constitutional morality.
Kashmir is witnessing a dark phase in terms of civil liberties. All the tactics of the government have failed to calm the rising temperatures in Kashmir. Though a logical mind may question the motives of the separatists for refusing to talk to the delegation, one needs to understand that it would in no way have resolved the actual issue. Dialogue that has happened in the past has proven to be aimed at merely restoring the current law and order in the valley and not a sincere effort to resolve the actual problem that time and again gives rise to such political crises in the state.
The intensity of the anger and the feeling of betrayal is increasing among the people of Kashmir at an alarming rate. The political lapses by the governments while dealing with Kashmir have created a sense of alienation in the state. If the government wants peace to prevail in the valley, it needs to rectify the wrongs.
Every time a Kashmiri is killed, it creates a sense of anger and deprivation. This is why we can see small kids, who don’t even know the real meaning of the word Azadi, out on streets, demanding the same. The present state of affairs, if continued, will only generate more hatred and more rebellion. It will not only make the present generation distrustful of the governments, but it will only also cause the future generations to lose their faith in democracy. Unless and until a concrete political solution is found, peace cannot be achieved. The people of Kashmir have suffered tremendously and have so far been deprived of every democratic right they are entitled to. Like Buddha said, “Only real victory was one in which all were equally victorious and there was defeat for no one. In the world today that is the only practical victory, any other victory leads to disaster.”
