Srinagar: Two policemen found guilty of culpable homicide in the case of killing of Wamiq Farooqa 7th class student who was hit by a police teargas shell on his head during the 2010 mass unrest in Kashmir were shifted to Srinagar Central Jail after the duo surrendered before the Court on Tuesday.
Earlier the Court of Forest Magistrate Srinagar B A Munshi had issued fresh non-bailable arrest warrants against Assistant Sub-Inspector Abdul Khaliq Sofi and SPO Muhammad Akram and had directed SSP Srinagar to execute the warrants and produce the accused before the court on December 1.
Both the cops surrendered before the Court on Tuesday and after which the Court shifted them to Srinagar Central Jail.
Pertinently on August 22, 2013, Chief Judicial Magistrate Srinagar had issued non-bailable arrest warrants against Sofi and Akram afteron the basis of a judicial inquiry and police probethe prima-facie guilt of the accused was established.
From the apparent perusal of evidence collected by the Judicial Magistrate in inquiry under section 202 of CrPC and the evidence collected by the SIT, such circumstances are spelt out which prima-facie indicate to availability of evidence which points out the culpability of ASI Abdul Khaliq Sofi and SPO Muhammad Akram, the CJM had ruled in his order.
A criminal complaint was filed by the complainant against the accused cops on 11 February 2010 and report in response to the complaint was submitted by SSP Srinagar on 19.02.2010. CJM Srinagar on 11 May 2010 had ordered Magisterial enquiry into the death of Wamiq.
After receiving the inquiry report, the Chief Judicial Magistrate Srinagar directed IGP Kashmir to constitute a special investigation team and also arrest and interrogate the accused persons, if necessary.
On 22 August 2013 the CJM directed the IGP Kashmir to get non-bailable warrants executed for the arrest of the accused, as they were found involved in the commission of offence of Culpable Homicide not amounting to murder under section 299 RPC. CNS
