JAMMU: The State Vigilance Commission has tendered its advise in 6 Roshini cases referred to the Commission by Vigilance Organization.
In a case bearing FIR No.6/2014 pertaining to conferment of ownership rights over JDA land to a private person in 2008, Commission while agreeing with the findings of Vigilance Organisation has advised it to ensure that all evidence connecting the involved public servants with the commission of crime should be brought on record so that the case is presented for prosecution with proper documentary and oral evidence linking the accused persons to the crime.
In this case Vigilance Organization has brought on record that in the year 2013 NOC has also been issued for construction on the said land by the then Chairperson JDA and has recommended departmental action against the then V.C. JDA.
The Commission while agreeing that the NOC prima facie should have not been issued has directed the Vigilance Organization to ascertain whether the case is made out for departmental action or regular investigation for the criminal investigation as this being separate occurance needs a separate and complete investigation.
In another important case bearing FIR No.18/2014 pertaining to allotment of land at Pulwama, the Commission observed that proper evidence has been collected and asked the Vigilance Organization to take further action for prosecution.
Another four cases were disposed off by the Commission pertaining to offences under ROSHINI Act wherein huge land has been allotted at below the market rates in violation of the Act and the Vigilance Organization has identified the accused and brought documentary and oral evidence on the record.
While agreeing with the Vigilance Organization, the Commission has given clear cut advice in these cases to present all evidence to strengthen these cases by bringing out role of each involved official and connect the accused officials with various criminal omissions and commissions so that the cases are put up for judicial determination with proper and unflinching evidence.
