JAMMU: In a major development on Thursday a Division Bench of the State High Court comprising Chief Justice M.M.Kumar and Justice Tashi Rabstan took serious note of the appointment of Professor N.K. Restura as chairman of the Jammu and Kashmir State Board of School Education and issued show cause notice to Secretary General Administration Department (GAD) and Secretary to Government School Education Department as to why Prof N.K.Resutra be not asked to step down as Chairman BOSE till he is cleared of the charges.
These significant directions of wide public importance were passed today by the Division Bench in a much publicized Public Interest Litigation titled Sheikh Muhammad Shafi vs Union of India in which today the Council for the petitioner, Advocate Shiekh Shakil Ahmed according to CNS drew the attention of the court to the controversial appointment of Prof N.K.Resutra as chairman BOSE when departmental inquiries are pending against him. He submitted that on July 8 this year, the DB had made serious observations against Prof N.K. Resutra and Prof Hemla Aggarwal. He further submitted that the BD had observed that some hidden hands are shielding these two officials of the Higher education department. He also submitted that Director Colleges was appointed as inquiry officer by the Higher Education Department to inquire into the allegations against the Prof N.K. Resutra.
Advocate S.S Ahmed further submitted that SVO also recommended regular departmental action against Prof N.K. Resutra for purchasing wifi at exorbitant while he was principal G.D.C Rajouri. Advocate Ahmed submitted that without awaiting the outcome of the departmental inquiries the state government appointed tainted Prof N.K. Resutra as chairman of the BOSE.
After hearing the arguments of the advocate S.S Ahmed the DB took serious note of the controversial appointment of Prof N.K. Resutra and referred to judgments of the SC wherein it has been stated that persons facing criminal charges or departmental inquiries should not be given responsible positions or public dealing posts. After registering the arguments of advocate S.S Ahmed the DB also considered the submissions of senior additional advocate general Gagan Basotra and issued show cause notice to the Secretary GAD and secretary School Education Department as to why Prof N.K. Resutra be not ask to step down as chairman BOSE till he is cleared of the charges.
The DB also issued notice to Prof N.K. Resutra for his response on the next date of hearing that is November 20. (CNS)
