Court issues warrant against Shaheen Spices

SRINAGAR: Puri Oil Mills Limited, a leading manufacturer and supplier of high grade P Mark mustard oil had filed suit in the Srinagar court (J&K) against Shaheen Spices for patent infringement i.e. for the duplicity of its propriety trade mark P Mark logo on their products (Masala or spices).

Puri Oil Mills Limited is the lawful registered user of trade mark P Mark under the Trade Mark Act 1958.

Puri Oil Mills Limited moved to court on 18th July 2013 for legal proceedings. The Srinagar court has issued bailable warrant to the Shaheen Spices and have summoned them to appear in court on next date of hearing 31 October 2013.

It has also directed S.H.O parimpora and S.H.O parimpore that the order is followed.

P Mark mustard oil is an 80 years old brand of the region and enjoys outstanding goodwill amongst the discerning consumers of J&K. Its not only part of their household cuisine but has become part and parcel of their heritage, tradition & festivities.

To make an attempt to pass off once goods as that of another deceptively is an outright violation of trademark act and is clearly an infringement. PR
