SRINAGAR: The enforcement squad of the SMC backed by district police razed down an illegal commercial structure at Habbak in the city outskirts today.
The applicant was granted permission in 2008 for construction of three storey residential house upto the plinth area of 1500 sq. Ft. But the applicant allegedly in violation of BOCA norms constructed the five storey residential cum commercial building upto the plinth area of 3400 sq ft.
SMC took action against the offender under the provision of J&K control of building operations act 1988 and the demolition order was passed for the deviation portion of the building.
However the offender had filed an appeal against the demolition before the designated court J&K special tribunal at Srinagar but the said court dismissed the appeal on 13.12.2012
Accordingly the SMC undertook the demolition operation today in presence of Commissioner SMC DR Qasba who was accompanied by the Joint Commissioner Administration Fayaz Ahmed Balla and other senior officers of SMC.
But an SMC handout said their squad faced resentment and protests and because women and children were living there as tenants the building was only partially demolished
The building was however sealed under section 8 of J&K Control Building Operations Act – 1988.
