Srinagar – Slaming at ruling National Conference (NC), oppostion Peoples Democratic Party (PDP) Wednesday said NC was misleading people for claiming the champion of autonomy and accused its founder, Sheikh Mohammad Abdullah as an eroder of the autonomy of Jammu and Kashmir at New Delhi’s behest.
NC try to mislead the public by making the statement in the assembly house that they are champions of autonomy. This is a lie and breach of privilege and an attempt to hide the sins committed in the past, senior PDP leader, Muzaffar Hussain Beigh told reporters outside the legislative house.
He said that in 1965, the autonomy in the state was intact as Jammu and Kashmir Legislative Assembly had power to re-elect back Sadr-e-Riyasat of the state by two third majority of house but in 1975 Shiekh Abdullah surrendered this power to New Delhi.
Either as a gift or in lieu of the returning to the chair, Sheikh Abdullah amended the section 147 of JK constitution on July 23rd 1975 which empowered the State Legislature the power of re-electing the Sadre-e-Riyast . But sheikh gave it in writing that state legislature would no longer enjoy the power to change the governor or dilute his powers till there was an assent from president of India on the issue, said Beigh.
No law made by the legislature of the State of Jammu and Kashmir seeking to make any change in or in the effect of any provision of the Constitution of Jammu and Kashmir relating to appointment, powers, function, duties, emoluments, allowance, privileges or immunities of the Governor; shall have any effect unless such laws has, after having been reserved for the consideration of the President, received his assent, reads the amendment order.
Beigh said that the 73rd amendment is not an issue as has been accepted by some of the leaders from the ruling coalition.
“Why does not the Assembly amend the state Panchayati Raj Act to provide for an elected chairman of the District Development Boards,” he said.
he said Shiekh surrendered the power of the State legislature of electing Sadr-i-Riyasat to India in lieu of the Chair.
PDP alleges that either as a gift or in lieu of the returning to the chair Sheikh amended the section 147 of JK constitution which empoers state legistaure the power of re-electing the Sadre-e-Riyast .
“But sheikh gave it in writing that state legislature would no longer enjoyt the power to change the governor or dilute his powers till there was an assent from president on the issue,” Beigh said
“This was all lie and breach of privellaige and an tatemtp to hide the sins committed in the past. But we maintained silnce in the House. When JK signed instrument of accession with Goi they had only powers over defense, communication and external affaris,” he added
The first order under which more than 75 percent of the autonymy was hsurrended to the Goi was signed by sheikh under constitution order in 1952.
Sheikh sahib was the first persons to make a sell out of JK autonomy in 1950 because he was made prime minister without support of any elected member.
In 195o sheikh removed the restriction laid by the Maharaja that GoI could have jursidction of making laws in three areasDefense, Communication and External afafirs.
Sheikh violated it and surrendered the autonomy first. Same happened in 1950 and 1952.
“The last nail in the coffin of the autonmy came by sheikh sahib in 1975. he himslef errode it for his own benifits,”he said
Meanwhile, Beigh later updates though social networking, facebook, “Chief Minister Omar Abdullah has approached New Delhi with a plea to advise state Congress unit to stop raising the issue of 73rd amendment in the Panchayati Raj Act in public.
