SRINAGAR Jammu and Kashmir High Court On Monday stayed operation of a government order by virtue of which the seniority of 1258 JEs (degree holders) and 907 JEs (Diploma Holders) were assigned the position in PDD.
Justice M K Hanjura stayed the operation of Government order (No. 268-PDD of 2017) dated 15.12.2017 along with other subsequent orders as well as circular whereby by the seniority of 1258 JEs (Electric)
degree holders and 907 JEs (Electric) Diploma Holders were assigned the position in the branch of PDD.
Court after taking over all view of the matter filed by two degree holder JE, stayed all the orders passed by PDD whereby seniority of degree as well as diploma holder JEs was fixed.
The Court has sought reply from Commissioner Secretaries of Law and PDD to the petition of the petitioners by or before July 21. The petitioners through their counsel Javaid Iqbal submitted that the authorities have wrongly assigned the seniority position of JEs diploma with JEs degree holders. They submit that some of the diploma holder JEs have played a mischief and got appointed as diploma holders as they (diploma holders) have a better and higher ration of quota available for appointment as JEs in comparison to the degree holders and such claim the benefit of degree having obtained by them prior to their appointment.
the petitioners submitted that the exercise taken by the authorities was tainted with malice and illegal as also the opinion extended by the Law department and the conclusion drawn thereof by the law department was illegal and against the settled principle and proposition of rule.
