SrinagarThe Jammu and Kashmir High Court on Wednesday expressed doubts on misuse of SRO-45, allowing use of 50 microns think polythene carry bags, and asked State Pollution Control Board to examine it minutely.
Hearing a Public Interest Litigation, a Division Bench of Justices Mohammad Yaqoob Mir and Ali Mohammad Magrey passed the orders after the Regional Director of SPCB made a statement before the court that the use of polythene in Pahalgam was strictly banned even as the polythene with 50 microns thickness was allowed by virtue of SRO-45 passed on February this year by the ruling PDP-BJP government.
Court while passing the direction observed that the court has strong doubts regarding the misuse of the SRO and how it was being implemented.
Subsequently, the court directed PCB to examine the SRO minutely and asked it what should be the mechanism in place.
Court also observed till the comprehensive report was filed there should be complete ban on use of polythene in Phalgam in addition to entire state. It has also sought production of SRO on next date of the hearing.
With regard construction in and around the resort, CEO PDA has been directed to strictly complied with the directions of the court and ensure no fresh construction to come up.
About the functioning of STPs in hotels situated in Pahalgam PCB has been asked to submit its latest status report before next date, indicating therein functioning of STPs in hotels which have more than 20-rooms.
Previously also, the court directed the SPCB to check the hotels and other commercial buildings as to whether the STPs were functioning properly or not.
It had also directed for complete action plan for treatment of sewage and solid waste and sought report whether the solid waste management rules of 2016 are implemented in letter and spirit. Wildlife warden was required to provide details regarding sanctuaries and other details.
The court had also directed in case application have not been filed before BOCA then the applicant shall approach the authority with one week and thereafter BOCA shall decide the same strictly in tune with Master Plan.
The court was hearing the PIL filed by Peoples Welfare Organization Pahalgam through advocate Parvez Imroz. It essentially seeks directions for the Protection of ecologically fragile environs of Pahalgam from further destruction and damage.
