SrinagarThe Jammu and Kashmir High Court has ordered Housing and Urban Development Department not to auction or allot 159 plots of land at Bemina housing colony here till further orders.
A bench Justice M K Hanjura issued notice to Commissioner Secretary H&UDD, Chairman Srinagar Development Authority, Vice Chairman SDA, Auctioning Committee and Board of Directors with a direction to file objections regarding the matter by or before December 4.
The respondents shall be restrained from auctioning, allotting or utilizing 159 plots of land at Bemina Housing colony earmarked for the SDA employees, the court said after hearing the petition filed by Employees Union of the Srinagar Development Authority. In their plea, they have stated that the Authority had to allot residential plots to its employees. They said that in the first instance, 28 plots were allotted to the employees and thereafter further 75 plots stand allotted among 75 employees of the Authority in the year 2006.
The remaining 159 employees, they submit, have been assured to be provided with such facility as and when the plots will be available and identified. Though 159 plots have been identified and were available with the Authority, they delayed the process of allotment in favour of Union, they said.
Having not done the allotment process, the employees were constrained to approach the court earlier and former directed the authority to consider the allotment of plots in favour of employees, they said.
The petitioner also alleged that despite the court direction, the authorities rejected their claim without considering the matter in its true perspective to allot the available plots amongst 159 left over employees.
