SrinagarThe Jammu and Kashmir High Court on Thursday directed authorities to remove all deficiencies as regards facilities being provided to inmates in orphanage and observation homes in the Kashmir Valley.
Hearing a Public Interest Litigation, a division bench of Chief Justice Badar Durrez Ahmad and Justice Ali Mohammad Magrey passed the directions after hearing amicus curie in the PIL, senior advocate B A Bashir.
The Court directed the authorities to remove the deficiencies immediately in light of rules under Juvenile Justice (protection & care of children) Act.
The amicus curie informed the court that the report of the department with regard to facilities available in observation homes was not adequate and not in conformity with the prescribed rules.
The amicus also submitted his report on points of action for improving the facilities in an observation home visited by him.
The division bench directed the Mission Director to remove these deficiencies immediately. Advocate B A Bashir in terms of previous directions also submitted suggestions for improving the conditions in observation homes and orphanages in the state, which the court has taken on record and directed the state to file response to these suggestions.
The court also directed State Sports Council to file compliance report regarding its directions to provide all kinds of sporting facilities at the children homes at Shalimar and observation Home at Harwan, both in outskirts of Srinagar.
We direct the Jammu & Kashmir State Sports Council to provide all kinds of sporting facilities at the children homes (Boys & Girls) at Shalimar and the Observation Home at Harwan. Proper coaching may also be provided, the court had ordered on previous date of hearing.
The PIL was initiated by the court by taking suo-moto cognisance of a news report on poor facilities at government-run orphanage at Shalimar.
