Srinagar: A local court has directed the Senior Superintendent of Police, Srinagar, to register an FIR against four persons including a paramilitary officer for falsely implicating a man in rape and murder charges.
Chief Judicial Magistrate, Srinagar, Virender Singh Bhou directed the SSP Srinagar to register an FIR against the CRPF officer, Satyaveer Singh Verma, who is second in Command at the 44th Battalion of CRPF at Zainakote Srinagar, a lady doctor, Pawanjeet Kour of Mattan, Anantnag, Alka Verma wife of the CRPF officer, and Muhammad Jameel, Probationary Sub Inspector at Parimpora Police Station.
The court directed the SSP to investigate the matter in accordance with law laid down by Supreme Court judgments in such cases and as per Criminal Procedure Code.
After hearing the petition filed by Deepak Kumar Kapoor son of Madan Lal resident of Kokar Bazar Maisuma Srinagar, who was falsely implicated by these four accused, the CJM said the allegations in the petition are serious in nature and constitute cognizable case.
Kapoor through his counsel has pleaded before the court that the police had not complied to the earlier court order and had not filed the FIR not was any investigation carried out .
The court also directed the SSP to monitor and see that the law of the land should be implemented in its letter and spirit.
The four accused had falsely implicated a man, Deepak Kumar Kapoor of Kokerbazar, Srinagar for attempt to rape (376) and attempt to murder (307) of the woman doctor at her office in 44-Bn Zainakote on September last year, where she is posted as contractual Medical Officer.
Kapoor has in his petition said to the court that he had love affair with Kour and had gone to meet her in her office at Zainakote.
But she along with the CRPF officer, Verma, staged a criminal conspiracy to implicate me in the false case. Kour and Verma had developed illicit relationship and thus wanted to implicate me to pave way for their marriage, Kapoor told the court adding that Verma helped female doctor to procure a false certificate from Chief Medical Officer Srinagar to get the job in CRPF.
Subsequently, on their complaint the police filed an FIR No. 266/13 under Section 307, 376, 511, 452 323 RPC at Parimpora Police Station in Srinagar against Kapoor, who was taken in judicial custody for 4 months after court directions.
However, the police after investigations into the case dropped the murder charges against Kapoor for lack of evidence and the charges of attempt to rape (376) and 511 were also scaled down to Section 354 by Additional District Judge Srinagar later.
Kapoor had prayed before the court to direct Inspector General of Police, Kashmir, or the Central Bureau of Investigation to lodge an FIR against the accused persons and investigate the matter for justice.
