SRINAGAR: A fast track court has handed over a death sentence to a man convicted of kidnapping and raping a minor girl in 2005.
The court of Sanjeev Gupta Thursday found Mohammad Rashid Kumhar, a resident of Magam, Kokernag in south Kashmir guilty of rape and murder of his 12 year old cousin on August 28, 2005.
The accused was given life imprisonment for rape and death penalty for murder by the court, the counsel for the victim said.
The victims father, Abdul Rehman Kumhar, a resident of Magam had lodged a complaint that his daughter was kidnapped by her cousin Rashid from her rented room in Jammu.
Kumhar had said in his complaint that his son Muzaffar Ahmad, brother of the victim, went out in search of her and when he reached near a deserted thoroughfare near Kachi Chawani in Jammu district late in the evening, he saw accused committing the crime.
However, the accused fled from the spot after killing the victim.
The police had filed a case and had booked Rashid under section 363,376 and 302 of the Ranbir Penal Code.
The judge in the case noted that Rashid stigmatized the minors future life and as such liberal view cannot be taken in favour of convict.
Reacting to the verdict Kumhar said: today first time since the incident I got sigh of relief. I heard that the accused has been awarded death for the heinous crime. I appreciate the fast track courts decision for giving us justice, he said.
