New Delhi: Chief Justice of India, Justice P. Sathsivam today fixed the date of September 30 for hearing a writ petition seeking direction from the Supreme Court to the J&K Govt. for holding fresh probe into the custodial death of NC activist Haji Yousuf.
Yousufs controversial death, during his questioning at the Chief Ministers residential office on September 29, 2011, had led to a storm in the mainstream political camp as his family members and several opposition parties levelled allegations of custodial killing against the Chief Minister and a coterie of his confidantes.
Mr. Yousuf had been called to Mr. Abdullahs residence after a National Conference (NC) worker and Mr. Abdullahs representative in Ganderbal Assembly segment, Mohammad Yousuf Bhat, complained that Mr. Yousuf had collected Rs. 87 lakh from him with the promise that he would be nominated as an MLC and thereafter a Minister of State in charge of the Public Works Department.
According to Mr. Abdullah and former Director General of Police Kuldeep Khodas statements, Mr. Bhat claimed that Mr. Yousuf had neither fulfilled his promise, nor returned the money to him. On Mr. Bhats verbal complaint Mr. Abdullah, as head of the party, called Mr. Yousuf for verification and handed him over to the then Inspector General of Crime, Raja Aijaz, for the registration of an FIR, investigation and returning of the money to the complainant, if established. Mr. Aijaz brought Mr. Yousuf to his office, where his condition deteriorated and he was admitted to the Police Hospital. He died the next morning.
Prof. Bhim Singh, senior Advocate mentioned this matter before the Division Bench headed by the Chief Justice of India, making a strong prayer to hear the matter relating to the custodial death of Haji Yousuf.
The bench comprises of the Chief Justice and Mrs. J. Ranjana Prakash Desai.
When the Chief Justice asked Prof. Bhim Singh how long shall he take to argue the matter, Not more than 15 minutes, Prof. Bhim Singh replied. A counsel on the behalf of the State of J&K was also present in the court.
